The Philippine Overseas Employment Administration last week barred eight (8) foreign
employers from hiring Filipino workers for default in contractual obligations, grave
misconduct, and gross violations of Philippine laws on overseas employment and
revoked the license of Amazon International Manpower Specialist, Inc. for various
violations of the POEA rules and regulations governing the recruitment and employment
of OFWs.
Administrator Hans Leo J. Cacdac identified the foreign employers that were disqualified from participating in the Philippine overseas employment program as Lae International Hospital Ltd; Al Yagoot Recruitment Office; Al Huda Engineering Works, Co. WLL; First Kuwaiti Trading Corporation; Al Asmi Manpower Services; Around the World Services/Proactive HR Solutions; Hanjin Trading Company; and Saweed Employment LLC.
Cacdac also prohibited Mal Lewis, chairman of the board of directors of Lae
International Hospital Ltd. In Papua New Guinea; and Epissan Mohd Ate Ter of Al
Yagoot Recruitment Office based in Saudi Arabia from recruiting workers from the
Philippines.
The case against Amazon International stemmed from the complaint filed by Arlyn S.
Pasadas and Mrynalyn J. Saguid who claimed they were deployed by Amazon to Albania
as cook and caregiver with a salary of US$500.00 but their employment papers did not
go through POEA process. The two also claimed they paid Amazon more than
Php100,000.00 each for placement fee.
The complainants said they left for Albania on November 30, 1010 using a multiple visa with an Amazon employee escorting them at the airport. They returned to the
Philippines on January 8, 2011 when their employer terminated their employment for complaining about violations of the terms and conditions of their contract.
In his order, the administrator declared Amazon International liable for charging
excessive fees and collecting placement fee from a household service worker, nonissuance of appropriate receipts, misrepresentation, deployment of workers to
employers without POEA accreditation, and other recruitment violations.
Cacdac imposed the penalty of cancellation of license on Amazon International for two counts of violation of the placement fee policy (Section 2 (b) Rule I, Part VI of the Rules and Regulations Governing the Recruitment and Employment of Land-based Workers). For the other violations, Cacdac meted Amazon the penalty of suspension of license for a period of eight months or fine of Php 80,000.00.
Cacdac also ordered the respondent agency and its surety, Country Bankers Insurance
Corporation, to refund the excess amounts collected from the complainants.
All officers and directors of Amazon International Manpower Specialist, Inc. at the time of the commission of the offense were also included in the POEA list of persons with derogatory records.
Cacdac advised jobseekers who have pending applications with the above-mentioned
companies and recruitment agencies to withdraw the documents they have already
submitted and find other reliable recruiters which can be found in the POEA list of
licensed agencies or its website poea.gov.ph.
