Immigration consulting firm padlocked

The Philippine Overseas Employment Administration last week closed down an immigration consultancy firm which was found recruiting Filipino workers for overseas employment. Administrator Hans Leo J. Cacdac ordered the closure of Sheen-Carm Visa Assistance and Consultancy Services located at No. 23 Villa Soledad Subdivision, Barangay 10, Lipa City after verification of its illegal recruitment activities by operatives of the POEA Anti-illegal Recruitment Branch.

In a mission report, the POEA operatives said that Sheen-Carm was actively recruiting cleaners and waiters for Dubai and caregivers for Israel in its office.

Posing as applicants, the operatives asked for available jobs and were interviewed by “Lourdes ‘Odet’ R. Castro” and “Eddie Reccio”. Castro and Reccio urged them to apply as caregivers for Israel because the “salary is much higher” at US$1,000 a month but they have to pay Php300,000 for processing fee. The offered jobs in Dubai pay a monthly salary of only Php14,000 with an
equivalent amount as placement fee.

Lourdes ‘Odet’ R. Castro, the POEA officers later found out, is the proprietor of Sheen-Carm and at the same time vice-president of a POEA-licensed recruitment agency based in Manila.

Under Republic Act No. 8042 as amended by Republic Act No. 10022, offering
overseas employment without the necessary license or authority from the POEA constitutes illegal recruitment.

In POEA Memorandum Circular No. 10, Series of 2003, immigration consultants are
required to obtain a license from the POEA before they may engage in recruitment and placement activities, regardless of the visa under which deployment shall be made eventually.

The officers and employees of Sheen-Charm face illegal recruitment charges and
their names would be included in the POEA List of Persons with Derogatory Record.

OFW recruiter in HK offers bogus Canada jobs

A warning to all overseas Filipino workers in Hong Kong: The Canada jobs offered by
Yamsuan and Associates Overseas Employment Services Ltd./Pacific Management Services Ltd. are non-existent! Citing a report from DFA’s Office of the Undersecretary for Migrant Workers’ Affairs(OUMWA), POEA Administrator Hans Leo J. Cacdac said Yamsuan and Associates has been posting ads in English newspapers in Hong Kong specifically targeting household service workers for supposed jobs in Canada.

“The advertisement says the agency can help them find work in Canada and
invites them to an orientation in its office,” according to OUMWA.

According to the Philippine Consulate General in Hong Kong, Yamsuan and Associates is owned and operated by a Filipino known only as Mr. Yamsuan and had Filipinos in its staff. Yamsuan has listed its Hong Kong address as 9th Floor, 4-6 Morrison Hill Road, Wanchai.

The OUMWA said at least 44 of the alleged victims of Yamsuan and Associates have filed complaints at the Philippine Consulate General in Hong Kong.

The complainants said Yamsuan charged them placement fees ranging from approximately US$100 to US$300 for “a job in Canada”.

When the promised jobs did not materialize, the applicants trooped to Yamsuan’s office, only to find it vacated and non-operational.

The Consulate General urged other victims of Yamsuan and Associates Ltd./Pacific Management Services Ltd. to come forward and file their statements with the Hong Kong police.

Cacdac advised applicants to be more vigilant and discerning in dealing with recruitment firms. “Scammers with tempting job offers are out there, waiting to pound on unsuspecting
applicants who are willing to part with their hard -earned money for a chance to work
overseas,” Cacdac said.

POEA goes after recruiters collecting placement fees from h ousehold service workers

Heeding the instructions of DOLE Secretary Rosalinda Dimapilis - Baldoz to make recruiters observe the reform package for Filipino household service workers (HSW) , Administrator Hans Leo J. Cacdac said the POEA is asking placement agencies to stop collecting placement fees from HSW applicants or risk losing their license.

Cacdac said there is total prohibition on charging placement fees from Filipino household service workers(HSWs), whether done prior to their departure or on - site through salary deduction, as provided by POEA Governing Board Resolution No. 6, Series of 2006. The administrator also warned recruiters not to circumvent the no-placement fee policy by collecting excessive fees supposedly for medical examination, training, video bio-data, and pre-departure orientation seminar.

Violation of the prohibition on placement fee collection is considered a grave offense whereby the imposable penalty is cancellation of license, regardless of the number of complainants.

Cacdac said that consistent with most host country regulations, employers shall pay a service fee to shoulder all the cost of hiring and deploying HSWs.“Very clearly, licensed agencies can still collect placement fee or service fee, provided that it should not be shouldered by the worker but by the foreign principal,”Cacdac added.

It can be done, Cacdac said, citing the case of a group of licensed recruitment agencies deploying HSWs to Hong Kong which has decided to scrap collection of placement fees from its workers. “I urge other recruiter associations to follow the lead of the 52 members of the Society of Hong Kong Accredited Recruiters of the Philippines (SHARP) , which have committed to support the government’s campaign to improve the welfare of Filipino household workers in other countries,” Cacdac said.
