POEA cancels license of misrepresenting recruiter

The Philippine Overseas Employment Administration canceled the license of
Dalandan International Manpower Inc. which was found liable of
misrepresentation in connection with the recruitment and deployment
of two Filipino household service workers (HSW) to Dubai, United Arab Emirates.

In his order, Administrator Hans Leo J. Cacdac said misrepresentation is
apparent when Dalandan International submitted to the POEA the documents
of two workers for processing as babysitter/domestic helper with a monthly
salary of US400.00, despite that their actual salaries were lower than the
minimum amount prescribed under the Governing Board Resolution No. 5, Series of 2006.

Cacdac said the two HSW were made to sign their respective employment
contract providing for a monthly salary of US$400. However, contrary to the
provisions in their signed contract, they were informed that they will only
actually receive salaries lesser than the agreed amount.

“Obviously, such misrepresentation was committed to facilitate the processing
of the documents of the workers before the Administration with dispatch since
they would not have been allowed to be deployed unless the stipulations in
the contracts of the workers complied with the provision of the rule,” Cacdac
added.

Section 2 (e) of Rule I, Part VI of the Rules and Regulations Governing the
Recruitment and Employment of Land-based Overseas Workers prohibits a
recruitment agency from engaging in acts of misrepresentation in connection
with the recruitment and placement of workers, such as furnishing or
publishing any false notice, information or document in relation to recruitment
or employment.

Cacdac said Dalandan further committed misrepresentation when it deployed
one HSW to a foreign principal which is different from the name of principal
appearing in her OFW Information Sheet. (POEA)
